A Virginia judge has dismissed all criminal charges against a former assistant principal linked to the shocking 2023 elementary school shooting in which a six-year-old student shot his teacher during class.

The ruling ends a closely watched legal case involving Ebony Parker, who had faced multiple felony child abuse charges over allegations that she ignored repeated warnings that the young student may have brought a gun to school.

The decision came more than two years after the classroom shooting at Richneck Elementary School in Newport News shocked the United States and reignited concerns over school safety and gun access involving children.

Judge Throws Out All Charges

Circuit Court Judge Rebecca Robinson dismissed all eight charges against Parker after ruling that prosecutors failed to prove their case.

The charges included accusations of child abuse and disregard for human life connected to the events leading up to the shooting.

During the hearing, Parker reportedly broke down in tears after hearing the decision.

The judge acknowledged the seriousness of the incident but said the evidence presented did not support criminal liability.

Teacher Was Shot by Six-Year-Old Student

The shooting occurred in January 2023 at Richneck Elementary School in Newport News, Virginia.

Teacher Abigail Zwerner was teaching a first-grade class when the six-year-old student pulled out a handgun and fired one shot.

The bullet passed through Zwerner’s hand before striking her in the chest.

She survived after undergoing emergency surgery and extensive medical treatment.

The incident shocked educators and parents nationwide because of the extremely young age of the shooter.

Lawsuit Claimed Warnings Were Ignored

Zwerner later filed a major lawsuit against school officials, arguing administrators ignored several warnings that the child may have been armed and behaving dangerously on the day of the shooting.

According to court filings, school staff members allegedly raised concerns multiple times before the incident occurred.

Alleged warnings included:

  • Reports that the child was behaving violently
  • Claims the student threatened another child
  • Concerns the child may have brought a gun to school
  • Requests to search the student’s backpack

The lawsuit accused Parker of failing to take immediate action despite the warnings.

Zwerner’s legal team argued that stronger intervention could have prevented the shooting.

Teacher Awarded $10 Million

A jury later sided with Zwerner in her civil case against Parker and awarded the teacher $10 million in damages.

The court found Parker’s inaction amounted to gross negligence.

The former teacher said the shooting caused severe physical injuries, emotional trauma, and long-term psychological effects.

The case became one of the most widely discussed school negligence lawsuits in recent years.

Defense Argued Parker Could Not Predict the Shooting

Parker’s lawyers maintained throughout the criminal proceedings that she could not have foreseen the shooting.

Her legal team argued there was insufficient evidence proving she knowingly ignored a direct threat.

They also challenged claims about the severity of Zwerner’s injuries and disputed accusations that Parker intentionally failed to respond.

The defense successfully persuaded the judge that prosecutors had not met the legal standard required for criminal convictions.

Child’s Mother Also Faced Criminal Charges

The child’s mother, Deja Nicole Taylor, separately faced criminal charges related to the firearm used in the shooting.

Taylor pleaded guilty to felony child neglect charges and federal gun-related offenses.

Authorities said the child used a handgun legally owned by his mother.

Investigators later discovered cannabis in the family home, which became part of the federal firearms case because US law prohibits active drug users from possessing firearms.

Taylor’s penalties included:

  • Two years on state child neglect charges
  • 21 months on federal gun charges
  • Guilty plea connected to firearm ownership violations

The case intensified national debate over parental responsibility and firearm storage practices.

School Shooting Raised National Concerns

The Richneck Elementary shooting received widespread attention because of the age of the student involved.

Education experts and lawmakers questioned how a young child gained access to a loaded firearm and brought it into a classroom undetected.

The case also increased pressure on schools to strengthen security procedures and threat assessment policies.

Parents and teachers across the US called for:
